Terms of Service

By creating an account or using Homeform ("the platform," "the Service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old to create an account. By using the Service, you represent that you meet this requirement.

You are responsible for maintaining the security of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at hello@homeform.ai if you suspect unauthorized access.

You may not share your account with others, create accounts on behalf of others without authorization, or use automated means to create accounts.

Tokens

AI visualizations consume tokens from your balance. Token costs are displayed before generation. Tokens granted with a subscription expire at the end of each billing period. Purchased (à la carte) tokens do not expire.

Tokens are non-transferable and have no cash value. We do not refund unused tokens except as required by applicable law.

Subscriptions

Paid subscriptions are billed in advance on a recurring basis (monthly or annual). You may cancel at any time; cancellation takes effect at the end of the current billing period and you retain access until then. We do not provide prorated refunds for partial periods.

We reserve the right to modify subscription pricing with 30 days' notice. Continued use after the effective date of a price change constitutes acceptance.

Your ownership

You retain ownership of photos and images you upload to Homeform. By uploading content, you grant Homeform a limited, non-exclusive, royalty-free license to store, process, and transmit your content solely to provide the Service to you (including sending your images to our AI provider for generation).

Your representations

By uploading content, you represent that:

• You own the content or have the right to share it for this purpose
• Your content does not violate any third party's intellectual property, privacy, or other rights
• Your content does not contain illegal material

Private styles

Style images you upload as personal references are private to your account and are not shared with other users. You may delete them at any time.

Subject to your compliance with these Terms, you own the AI-generated images produced in your account. You may use them for personal and commercial purposes.

You acknowledge that:

• AI-generated images are produced by Google's Gemini AI and are subject to Google's usage policies
• Results may vary and we do not guarantee specific outcomes
• Generated images may not perfectly reproduce product appearances shown in reference images
• Homeform does not warrant that AI-generated images are suitable for any specific professional or legal purpose (e.g., construction permits, architectural drawings)

Product information

Homeform lists products from third-party brands. Product availability, pricing, and specifications are provided by brands and may change without notice. Homeform is not responsible for the accuracy of product information provided by brands.

Purchases

When you purchase a product through Homeform, your transaction is with the brand selling the product. Homeform facilitates the transaction and charges a 2.9% platform fee on the total order value. Returns, refunds, and warranties are governed by each brand's individual policies.

Stripe

All payments are processed by Stripe. By making a purchase, you also agree to Stripe's Consumer Terms.

You agree not to:

• Upload images that contain illegal content, nudity, or content that violates any person's privacy or rights
• Use the Service to generate content that harasses, threatens, or demeans others
• Attempt to reverse-engineer, scrape, or extract data from the platform in unauthorized ways
• Use automated bots or scripts to generate images or interact with the platform
• Circumvent token limits, access controls, or other platform restrictions
• Resell access to the Service without authorization
• Use the Service in any way that violates applicable law

We reserve the right to suspend or terminate accounts that violate these rules without refund.

The Homeform platform, including its design, software, trademarks, and content (excluding user-uploaded content and AI-generated outputs), is owned by Homeform and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from Homeform's proprietary materials without our written permission.

Product images, brand assets, and product descriptions remain the intellectual property of their respective brand owners.

Curated Room Styles available in the Homeform marketplace are created by independent designers. When you purchase a Room Style, you receive a license to use it for personal visualizations. You may not redistribute, resell, or sublicense purchased styles.

Designers who submit styles to the Homeform marketplace agree to a separate creator agreement governing revenue sharing and content standards.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated visualizations will accurately represent finished construction or design work. Homeform visualizations are intended for inspiration and planning purposes only — not as professional architectural, engineering, or design drawings.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOMEFORM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising out of these Terms or the Service shall not exceed the amount you paid to Homeform in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless Homeform and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your uploaded content, or your violation of these Terms.

You may delete your account at any time from your account settings. We may suspend or terminate your account at any time for violation of these Terms, with or without notice, and without liability to you.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms will be resolved exclusively in the applicable courts of competent jurisdiction.

Before filing a formal dispute, you agree to contact us at hello@homeform.ai and attempt to resolve the matter informally for at least 30 days.

We may update these Terms from time to time. When we make material changes, we will update the effective date and notify you by email where required. Continued use of the Service after the updated Terms take effect constitutes your acceptance.
